  1.   NY bar MBE section - PMBR v. Barbri #1
    I'm taking the NY bar in July so I'm using the PMBR books and barbri ipod lecture. People's advice was that barbri has better outline, but PMBR has better questions. So I'm using barbri outline and using PMBR books. What people say about PMBR, is it true?

    My next question is what if the concept laid out by barbri outline is slightly different from PMBR outline/answer section?
    For example, pinkerton rule on conspirator liability. PMBR states pinkerton rule as "all co-conspirators are liable for all crimes committed by any conspirator in furtherence of the original agreement" in one of its answer section. Barbri, in contrast, does not state the name of the rule, but states the rule, AND adds another element - the foreseeable element to it (Multi state, criminal law page 15). So in short, barbri adds one more element to the same rule. I know this is really a small difference, but I think it's important because two or three conspiracy questions seem to appear in MBE. Which one should I rely on?

    Also the next question is regarding barbri lecture. Did anyone find that some legal concepts in the lecture is stated differently than in the barbri outline that sometimes it's just confusing? e.g., self-defense in criminal law.

    That's great you are so detail oriented b/c a good attorney will need that. However, on the bar exam, you have to quit analyzing little things like that. As a general rule, follow PMBR for all the MBE subjects and follow Barbri for all the state specifics

    Either way, stick with one and use that to be your guide. don't waste any time analyzing details

    I sat the Feb 08 and missed it and was wondering if you be so kind as to give me a little advice on passing. One thing I didn't do was practice MBE questions or even look at essay answers prior to the exam. Instead I focussed on learning the subjects. I guess this is where I fell down.
