Anyone have the essay predictions for the upcoming NY Feb 2008 Bar exam???? What did Barbri have to say this go round??? Please post.

I don't have Barbri predictions, but here is what I believe will be on the exam based on published charts:

Contract/Sales
Professional Responsibility
Wills
New York Practice
Torts
Domestic Relations
Corporations and Partnership (Fiduciary Duty/Agency)
Evidence
Real Property/Mortgages
Secured Transactions
Commercial Paper

This is Pieper's prediction for 2006 and 2007 Feb bar exam (they were almost identical) So I thought I would post it b/c the major issues still apply

Essay #1 (2 Contract law issues / 1 Corp issue):
Favorite area in Corp is piercing the corporate veil
Probably not UCC Article 2 sales, but if sales then probably sales remedies (SPARKLE and CID’S WAR)
Probably traditional contract law: remedies, risk of loss (new construction or a real property contract) and defenses (I2 FU2MED & I SIP), liquidated damages

Essay #2 (Crim Pro / Crim Law):
Probably not 4th Amendment (a search without a warrant is prima facie unconstitutional. but courts have carved out certain BACH’S PIES exceptions), but if 4th Amendment then probably consent searches or plain view searches
Probably right to counsel, Miranda, or line-up IDs
Probably conspiracy and murder, but probably not attempt
EVADE NICE WASP MICE defenses

Essay #3 (Family Law / Real Property):
Favorite testing areas are concurrent estates and adverse possession
Probably easements (PIGS), defeating easements, and a real property contract (risk of loss) 2-1 odds on A PAIN and equitable distribution, (e.g. P’s suing for the wrong COA by choosing a wrong A PAIN ground)
Probably child support or child custody

Essay #4 (Torts)
Probably negligence and negligence principles (FIT, DIP, F CLIPS, and LARGE CD2)
Also conflict of laws or federal diversity jurisdiction likely here too (loss allocating rules and conduct regulating rules)
Probably a partnership or agency issue likely here too

Essay #5 (Wills)
Probably SWEPT wills, partial revocation of a will, lapsed legacies and anti-lapse statutes, interested witnesses, and advancement
This is the 5 year perpetuities anniversary, but it’s not guaranteed to be there. Know a basic definition of a perpetuity, ABC vesting, and A FUR cures.(especially the age reduction contingency
