Regarding copyright, is it ok to sell those materials I bought from BarBri, Pmbr, Barpasser, bar secrets, flash cards, and audio CDs? I wanted to sell them on Ebay, but was confused by the concept of some companies framing the books as "leases" and prohibit sale of leased books....and the first sale exception where a person who rightfully bought it can transfer it once....just confused about how it applies to various companies since they might each have framed it differently in their contract provisions.

What are they going to do, just sell it

Honestly tho, even if the contract says you can't sell them, and you are just leasing them, I still think that contract should not be enforceable b/c it is not conscience.

We have the first right to sell, and don't tell me I don't own those books after paying you 2-3,000 US dollars!!!

Check your contract

Unless there is indeed some sort of "lease" agreement (I guess that would be in the contract you signed with the bar review company), you have a great deal of discretion regarding what to do with the books/ cds/ flashcards/etc. themselves. (As we've discussed, copying them, be it for fun or profit, is a whole 'nuther thing.)

Some people hang on to their materials (they can be quite handy "quick research" material), some people throw them away (a waste, IMO), some people give them away, some people donate them to their (or another) law school. I've also seen them for sale on eBay, Craig's List, and some law school/legal bookstores.
