penalty fines on late filing of federal tax and state tax return a debt in surrogate court?

If in surrogate court attorneys fail to mention the outstanding daily accruing debt of penalty on the late filing of the federal and state tax of an estate and they continue to proceed in court for fees for the executor of the estate knowing the debt is still unpaid, would this be a basis for ethics regarding the attorney's especially if the judge is not made aware of the fact of the continuing debt and non payment.

This is a really tough question to ask here!!!

Which jurisdiction are you in? If the attorney is "knowingly concealing" this fact, then I guess absolutely you can use that to challenge attorney's ethics because an omission of fact is just like lieing. Are you in NY or NJ? cuz' CA doesn't have surrogate court.
